Slip and Fall Compensation Claim by Chef

I have used the United States legal term "Slip and Fall" for this example, as it wouldn’t make sense to use "slip and trip compensation claim" since that would cover two types of accidents. Collectively, "Slips and trips" are the most common of workplace hazards here in the UK, with the HSE reporting that these accidents make up for a third of all major injuries with thousands of workers suffering due to a slip or trip each year. HSE note that chefs, kitchen assistants and waiting staff tend to be the most affected occupations from slips and trips, which is the reason why a chef was used as the example today. It is fully understandable as well, with the thought of food and water spillages, hot oil, trip hazards from loose stock and so on. Chefs tend to be rushed, working long hours and so the accidents that occur are not surprising.

Tinnitus Compensation Claim by Barman

There are a large number of occupations whereby workers are exposed to dangerous levels of noise and serious hearing problems can result from this exposure. This work accident compensation example is focusing on a tinnitus compensation claim by a barman in a nightclub. Tinnitus will cause ringing in one or both of the ears, although it can also take the shape of various other strange noises in the ears and the severity of this injury can be mild to severe. Industrial deafness is defined as "the permanent loss of hearing caused by exposure to industrial noise in a worker's employment". Industrial deafness is an extreme and leading up to this we have various levels of hearing loss that usually compliments tinnitus. The barman in question working in a nightclub will be exposed to loud music throughout their entire shift and many have worked in these environments for many years.

Using an Accident at Work Solicitor with Lexcel Accreditation

The posting "How to Find a Solicitor" provided a few insights into the basic steps taken to find a solicitor that can take on a work accident compensation claim. This posting is looking specifically at accident at work solicitors that have the Lexcel Accreditation Award. To explain just what this is, the Solicitors Regulation Authority (SRA) is the regulatory body for solicitors in England and Wales. The SRA is a part of The Law Society, although it operates separately from it. The Law Society represents solicitors in England and Wales and awards the highest quality legal firms with what is called Lexcel Accreditation that signifies the highest management and customer care standards. If you use an accident at work solicitor that has this award, then there will certainly be some real value in the service that is on offer to you.

Repetitive Strain Injury (RSI) Compensation Claim by Office Worker

Office work stands as one of the safest work environments, but there are still concerns that need to be addressed here. Stress is a common issue in office work and this stress could have of course arisen from workplace bullying that can lead to post traumatic stress disorder (PTSD). This is prominent in various working environments and so it will be studied on another day. The chosen topic today is repetitive strain injury (RSI). This counts as an industrial disease where continuous repetition over time has lead on to either mild or severe symptoms of pain due to the muscles, nerves and tendons. The computer is of course creating these RSI compensation claims in the office environment. Many office workers work on the computer for long hours and you do hear of those who work with no breaks (which is against the law).

Machinery Accident Compensation Claim by Factory Worker

The manufacturing of goods in a factory can be problematic with the regular use of dangerous machinery throughout the day. Manufacturing accidents are less common than in other industries, yet when these accidents do happen these injuries tend to be extremely severe. The training needs to be thorough, yet it doesn't help that factory workers are often working long hours, rushing to meet tight deadlines, using equipment that may be well past its sell by date. A factory accident compensation claim could of course concern perhaps a slip or trip on a factory floor that would be a major concern if any hot or toxic materials or liquids are being used. In manufacturing, I studied some HSE statistics that noted that Since 1981 the rate of fatal injuries has fallen by over half (57%), which is at least good news for this sector.

Tractor Accident Compensation Claim by Farm Worker

Agriculture stands as the most dangerous working sector today here in the UK. Construction slightly has the most fatality counts, but closely followed in second spot is agriculture. When it comes to non-fatal injuries, agriculture sits at the very top of the tree and so there is no doubt that this sector is an extremely dangerous one. Agricultural machinery and vehicles tend to be most problematic that of course covers this tractor accident by a farm worker. You can perhaps understand why agricultural accidents are so common when carried out in poor weather conditions. Working in such conditions under pressure is a major concern and shortcuts are usually taken such as not wearing the required protective clothing. Dangerous machinery is used throughout the day, with loud noises, surrounded by livestock and workers may of course be young and lacking in regards to the required training.

Dog Bite Compensation Claim by Postman

When there is an incident involving a dog bite and a child, you will almost certainly hear about it in the news. A number of dogs do receive bad press and some are of course banned here in the UK. The law in place with the Dangerous Dogs Act 1991 has banned the Dogo Argentino, the Fila Brasileiro, the Japanese Tosa and the Pit Bull Terrier (cross breeds of each four are included). I have never quite understood why these breeds were cherry picked! The Pit Bull has always had the worst record for fatalities, but I have wondered why the Rottweiler gets a free ticket since it has the second highest record. In fact, just studying the fatalities in 2011 it was Pit Bull-type in first spot and Rottweiler in second. One of the Rottweiler victims last February was 66 years old and so it is not just a case of young children being at risk.

Scaffolding Accident Compensation Claim by Construction Worker

The HSE reported that the most fatal work injuries took place in the construction industry. With non-fatal injuries, construction was still relatively high in third spot. There are a couple million construction workers here in the UK and it is known as one of the most hazardous environments to work in and so you would always expect the incident counts to be very high in this industry. The most common problem for the construction worker has always been scaffolding accidents and scaffolds are used on most building sites. Scaffolding compensation claims will always be of high value since the injuries tend to be significant (if not fatal). Some common scaffolding accident causes could include insecure bracing, use of shoddy construction materials or perhaps a lack of attention to the required safety procedures. Quality management and training will always minimise these risks.

Fatal Accident Compensation Claims at Work

This posting will briefly introduce fatal accident compensation claims, in particular fatal work accident compensation claims. This is a specialist area for solicitors, but it is more common that one may imagine. If I just refer to the (HSE's Work Accident Statistics | Work Injury Statistics) posting, within the given year 152 workers died. The most problematic sector was construction accounting for 42 fatalities, whilst agriculture stood in second spot accounting for 38. The number of workers that died from diseases was much larger in the region of 8000 cancer deaths and 4000 COPD deaths. Of course, industrial disease compensation cases are always more complex since for example mesothelioma symptoms are appearing after a considerable period of time (50 years). The pattern surrounding any such work death, is that if there is negligence, then there will certainly be a claim.

100% No Win, No Fee Accident at Work Claims

The previous posting (How to Find a Solicitor) provided a few tips for those looking to find legal assistance for a work accident compensation claim, whether chased up by the individual involved in the accident or if it happens to be a more severe accident then naturally a family member would make the enquiry. The requirement of finding a no win, no fee solicitor was introduced in that post and today this will be discussed further. You will tend to find in the world of personal injury that most UK legal teams will provide a no win, no fee service; many have had to adapt and add this concept as without it they would struggle to attract clients in this ever competitive legal industry. The concept will be explained here, but if more information is required then it is recommended that you should speak to a solicitor who has professional and valued experience in the field.
